Thea, Inc. (“we,” “us” or “our”) values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use and disclose personal information when you access and use our website at www.theavoice.com (“Site”) and our mobile application (“App”) and any services we may provide through the Site and App (collectively, the App, Site and services will be referred to as the “Services”). By visiting or using the Site or providing us your personal information or downloading or using our Services, you agree that your personal information will be handled as described in this Policy.
Capitalized terms in this Policy that are not defined in this Policy shall have the meanings set forth in our Terms of Use.
The Information We Collect About You
We collect personal information about you directly from you and from third parties, as well as automatically through your use of our Site and Services. “Personal information” for purposes of this Policy means information that is protected as personal information or personal data under laws applicable to us.
Information We Collect Directly From You and Third Parties. The Service is an application that listens to your voice and offers emotionally attuned sound and other suggestions to help you reset, regulate and return to yourself. We collect personal information directly from you in several ways:
Registration: When you register for the Services, we collect your name and email address and other unique identifiers such as your account name and passwords. We may also collect your age, date of birth and gender. We use this information to manage and monitor your account and provide you the Services, and for marketing and other purposes as outlined in this policy.
Voice Recordings and User Content: If you use our Services, with your permission, we record your voice (“Voice Recordings”) and collect your responses to prompts and questions and other User Content to provide, maintain and improve the Services, and for marketing and other purposes outlined in this policy.
Social Media Information: We may offer the ability to log into our Services using your social media account. In such a case, we may collect your login and other information from your social media account to facilitate access to your account and your use of the Services.
Commercial Information: We collect information regarding the Services and products you purchase from us, including credit card and other payment information that is processed by our payment providers.
Communications and Customer Service: We will collect your contact information and other information you provide if you complete contact forms on the Site or email us with questions about our Services. We use this information to respond to your inquiries and provide and maintain the Services and for other purposes as outlined in this Policy.
Resultant Data: You agree that we shall have the right to collect and analyze data and other information relating to the provision, use and performance of various aspects of the App and Services and related systems and technologies (including, without limitation, information concerning User Content, personal information and data derived therefrom) (collectively, “Resultant Data”), and we will be free (during and after your use of the Services) to (i) use such Resultant Data to improve and enhance the Services, for training artificial intelligence and machine learning models, and for other development, diagnostic and corrective purposes in connection with the Services and other Thea products, services and offerings; and (ii) disclose such Resultant Data for marketing and other purposes. This Resultant Data is generally processed and used on an anonymous or aggregate basis.
In addition, if you are providing personal information for third parties in connection with using our Services, you are responsible for ensuring that you have all required permissions and consents to provide such personal information to us for use in connection with the Services and that our use of such personal information to provide the Services does not violate any applicable law, rule, regulation or order.
Information We Collect Automatically. We may automatically collect the following information about your use of our Site or Services through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; your device ID; your advertising ID; the length of time you visit our Site or use our Services; and the referring URL, or the webpage that led you to our Site. We may combine this information with personal information that we have collected about you, including, where applicable, your name and other personal information. Please see the “Our Use of Cookies and Other Tracking Mechanisms” section below for more information.
How We Use Your Information
We use your information, including personal information, for the following purposes:
Communications. We use your personal information to communicate with you about your use of our Site and Services, respond to your inquiries, and provide customer service.
Provide Services. We use your personal information to tailor the sound, content and information that we may send or display to you, to offer location customization, personalized help and instructions, and to otherwise personalize your experiences while using the Site and Services.
Improve and Develop Our Services. We use your personal information to: (a) ensure our Site and Services are working as intended; (b) operate our business; (c) better understand how users access and use our Site and Services, both on an aggregated and individualized basis; (d) develop, maintain, protect and improve our Site and Services, (e) train any artificial intelligence and machine learning or large language models we may employ in connection with our Site and Services, and (f) perform research and analytics, including to analyze and report on usage and performance of our Sites and Services.
Marketing and Promotions. We may use your personal information for marketing and promotional purposes. For example, we may use your personal information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you or direct targeted advertising to you.
Sale and Share for Targeted Advertising and Cross-Context Behavioral Advertising. We do not sell your personal information as such term is defined in applicable data privacy laws, but may share your personal information with third parties for targeted advertising or cross-context behavioral advertising.
Compliance. We may use your personal information to: (a) detect, investigate, and prevent activities on our Sites and Services that may violate our Terms of Use, could be fraudulent, violate copyright or other rules, or that may be otherwise illegal; (b) comply with legal requirements; (c) defend or exercise legal claims; (d) respond to law enforcement or governmental investigations or requests; and (e) protect our rights and the rights and safety of our users and others.
How We Disclose Your Information
We may disclose your information, including personal information, as follows:
Consent. Where you have provided consent, we share your information, including personal information, as described at the time of consent.
Affiliates. We may disclose the personal information we collect from you to our affiliates or subsidiaries solely for the purpose of providing Services to you; however, if we do so, their use and disclosure of your personal information will be in accordance with this Policy.
Service Providers/Subprocessors. We may disclose the information we collect from you to third-party vendors, service providers, subprocessors, contractors or agents who perform functions on our behalf. For example, we use various subprocessors (“Subprocessors”) to assist us in providing the Services, including, but not limited to, Valence Vibrations, ChatGPT, and Deepgram – by using the Services, you agree to their processing of your Voice Recording and other personal information as specified in their terms and privacy policies, which can be accessed here: https://openai.com/policies/privacy-policy/, https://www.getvalenceai.com/privacy-policy, and https://deepgram.com/privacy.
Business Transfers. If we are acquired by or merged with another company or entity, if substantially all of our assets are transferred to another company or entity, or transferred as part of a bankruptcy proceeding, or are in negotiations for any of these types of transactions, we may transfer the information we have collected from you to the other company or entity. We may share your personal information with professional advisors (e.g., bankers, lawyers, accountants) and potential buyers and vendors in connection with the sale, disposal or acquisition by use of our business or assets.
In Response to Legal Process or Government Request. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a subpoena, or in response to a request from law enforcement or other governmental authority.
To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we are involved.
Aggregate and De-Identified Information. We may share aggregate or de-identified information about users and their use of the Services with third parties and publicly for marketing, advertising, research or similar purposes.
Social Media Platforms
Where you choose to interact with us through social media, your interaction with these programs typically allows the social media company to collect some information about you through digital cookies they place on your device and other tracking mechanisms they place on your device. In some cases, the social media company may recognize you through its digital cookies even when you do not interact with their application. Please visit the social media companies’ respective privacy policies to better understand their data collection practices and the controls they make available to you.
Our Use of Cookies and Other Tracking Mechanisms
We may use cookies and other tracking mechanisms, such as web beacons, to track information about your use of our Site and Services. We may combine this information with other personal information we collect from you (and our third-party service providers may do so on our behalf).
Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies), but such disabling will impair use of the Site and Services.
Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Services. Strictly Necessary Cookies: These cookies are necessary for the Site to function and cannot be switched off in our systems. Disabling Cookies. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. Visitors to our Site who disable cookies will not be able to browse certain areas of the Site or use the Services.
Third-Party Links
Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.
Security of My Personal Information
We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse and unauthorized access, disclosure, alteration and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.
You should take steps to protect against unauthorized access to your password, phone and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen or compromised passwords or for any activity on your account via unauthorized password activity.
What Rights Do I Have Regarding My Personal Information
You may have rights under various state laws regarding your personal information. For example, depending on whether you are a resident of a state whose laws apply to us, you may have some or all of the following rights:
Right to Know: You may have the right to know what personal information we have collected about you, including the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, “selling,” or “sharing” personal information or processing for “targeted advertising,” the categories of third parties to whom we disclose personal information, the categories of personal information disclosed to third parties, and the specific pieces of personal information we have collected about you in a usable format.
Right to Data Portability. You may have the right to access your personal information in a portable format.
Right to Delete. You may have the right to request that we delete the personal information we have collected from or about you, subject to certain exceptions.
Right to Correct. You may have the right to request that we correct inaccurate personal information that we maintain about you.
Right to Opt Out of Targeted Advertising, Sale or Sharing of Personal Information. You may have the right to “opt out” of “targeted advertising” and the “sale” or “sharing” of your personal information.
Right to Appeal. Certain states permit you the right to appeal a decision we have made in connection with your privacy rights request.
Right to Non-Discrimination. You have the right to not receive retaliatory or discriminatory treatment in connection with a request to exercise your rights, subject to certain exceptions.
Authorized Agents. You may have the right to use an authorized agent to make a request on your behalf.
You can make a request under these laws (including an appeal) by contacting us at privacy@theavoice.com. We reserve the right to deny a request if these laws do not apply to us. We may request additional information to verify the identity of the requesting party before responding to a request or if you are using an authorized agent, proof as permitted by applicable law, that this authorized agent is authorized to act on your behalf.
What Choices Do I Have Regarding Use of My Personal Information for Marketing?
We may send periodic promotional or informational emails or push notifications to you. You may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.
Retention of Personal Information
We generally retain your information for as long as you have an account or as necessary for the purposes for which it was collected. We may also retain your information if required by law or for accounting purposes, or to exercise or defend legal claims. Voice Recordings are generally stored for 24 hours and then auto-deleted.
Location of Personal Information
Our Site and Services are offered from the United States intended for use in the United State and our App is only available for download by users in the United States. We store any personal information we collect in the United States. If you access the Services or Site from outside the United States, you agree to the transfer of your information to the United States, which may have less protections for your personal information than your jurisdiction of residence.
Children Under 18
Our Site and Services are not designed for children under 18. If we discover that a child under 18 has provided us with personal information, we will delete such information from our systems.

Changes to this Policy
This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on the Site. If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our Site or if you have an account with us, providing notice to the email address in your account (for this reason you should make sure to update your account information promptly if it changes).
California Shine the Light Law: In addition, under California Civil Code § 1798.83, California residents who have provided personal information to us may obtain information regarding our disclosures, if any, of personal information to third parties for third-party direct marketing purposes (please note that we do not currently disclose personal information to third parties for such purposes). Requests must be submitted to the following email address: privacy@theavoice.com
Within 30 days of receiving such a request, we will provide a California Privacy Disclosure, which will include a list of certain categories of personal information disclosed during the preceding calendar year to third parties for their direct marketing purposes, along with the names and addresses of the third parties. This request may be made no more than once per calendar year.
